If you want to send internal HTML emails, I recommend using something like MailChimp. Keep it out of Marketo. Also MailChimp is much more user friendly for casual users. You could help them set up a branded template. Our People Operations team uses MailChimp to send internal newsletters.
Our Consent to Processing field and Consent to Direct Marketing field are both string (picklist) with "Yes" and "No" as possible values—but we don't use Marketo forms so we don't have the same restrictions. You should probably do boolean (checkbox) to get it to show.
Jessica, this is super helpful. I just came across this scenario today. We are syncing a list with AdRoll (coincidentally enough) and they can only accept static lists. I'm going to use a dynamic list and batch smart campaigns to update the static list.

How many people have said that the unsubscribe link doesn't work? Have you tested it yourself? Our unsub link/page/form works just fine, but occasionally people will reply via email and say it doesn't work...*shrug*
