I considered the time constraint to be implicit in the wait step, and since you didn't specify a time constraint in your Smart List, I assumed you were doing so as well.
Alternatively, instead of making a separate Smart List for "No Webpage Visit", you could use the choicesif Not Visited Web Page is [specified page] -> send emailandif Not Visited Web Page is [specified page] -> Add to ListUsing the inactivity filter saves the added bulk of an added Smart List.

I agree that the human factor is much more significant than the possibility that an email security program might take exception to the mismatch.
And yes, I believe this would work for older email systems as well as current ones. I've not yet come across a situation where they were unable to use the regex header due to old technology.
