I experienced the same issue this morning. I updated as Steven Vanderberg suggested and the problem is now solved!
Ah, yes, that makes things more fun Could you do "NOT Activity was Logged/Updated" then?It wouldn't solve the SFDC migration dates issue (we have issues with that data ourselves), but could work for the more recent stuff.

I'd also look into knak. , whose downloadable Marketo email (and landing page!) templates are responsive, so they should work well in a wide variety of clients and browsers. I think you get to edit one for free when you first sign up.

Yup - this screen shot shows that each checkbox has its own field, so you'd just want to create a new one for the mailing list subscription.
Correct. Once you have your new field added as a checkbox, then your Smart List would just be something like, "MAILING LIST FIELD NAME = TRUE". Unfortunately, it's not automatic like on other services like MailChimp, where lists can be added to the forms without setting up more logic.
You can create new fields in Admin > Field Management. You'll be able to confirm if this is the case if these checkboxes appear in the fields list.
