We use JQuery in the past to do Explicit opt in.With new Forms 2.0, you can add visibilty rules to a field if another field on the form is not empty etc.
I think you need to be visited by that domain first before Marketo filter can pick it up to use it.Same deal when using a new webpage on your domain that is going to be used in a smart campaign with a filter 'visits web page' is x. If there has been no visits.

Some simple Jquery on the landing page set up to look for the @gmail.com, @aol.com @hotmail.com etc. can do the trick.
You could have a lead report set up with 3 smart lists added as custom columns. Each smart lists have a filter of clicks link on landing page x.Then in your lead report you use the smart list section to narrow down to the audence you care about

Do you mean append a static list?Have a smart campaign running with requirements that once met, will be added to your static list.
Was going to suggest create a custom picklist in SFDC with values of current lead owner and previous lead owner. Then you can use the Data Value Changes, select the new custom field and use a constaints New value is X and Previous value is X. But you say that is hard to do, could that work for you?
You may want to think about removing the Unsubscribe text from the admin and keep it in the footer of your email as a global snippet, this way you have more control from a style perspective rather than Marketo adding it to the bottom of all emails by default.
