You could just create a nested email program for that new email and take everyone who is exhausted and add them to a static list (XYZ) so that in the nested email program your smart campaign to send the email has a Member of List not in XYZ. So the "any" part of the trigger works just fine, it's the minimum number of times that doesn't work. Haven't found a way around it yet.
