Yeah, I double-checked. No emails are operational and if the person is over communication limits, the smart campaign settings are set to block non-operational emails.

Should I raise a ticket?
Although i have never heard or faced any such issue, but i think it will be a good option to submit a ticket for support.
I haven't come across a situation where Marketo sends more marketing emails than the set communication limit. Ideally, your communication limits should align with the number of marketing emails you expect to send. These limits act as a safety net, ensuring people don’t receive too many emails (aka email fatigue). If you frequently see people missing emails due to exhausted communication limits, it’s a sign you may need to either adjust your communication limits or maintain a structured marketing calendar (e.g., 3 nurture emails in a day does sound a lot) to better manage email volume. In most cases, it's prudent to go with the latter before you update your communication limits.
I raised a Marketo Support ticket and the concern is resolved. The above said records bypassed communication limits because of a race condition in which engagement streams from all three nurtures were processed at the same time without each having a view into the other's cast.
Hence the support suggested that we change the engagement program's cast by 5 minutes i.e 10.00 am, 10.05 am, 10.10 am which will prevent records from bypassing the set Marketo communication limits.
