Are you simply using, "Member of Smart List" = False, when sending emails to make sure these aren't being sent to?
If the alert was not successfully sent it would show an error on the activity log. Had the same issue that the alert/task were sending out before it was assigning a Lead Owner and had to throw in a wait step.
It does look like they are coming through at the same time but each one is being sent the email, I spoke with Marketo Support to confirm. Each record in this instance is a separate business but has the same owner and email address.
