I want to answer the question.

While sending to List X
      If Lead is on List Y
          Do Not Send Email to Lead
      End If
End While
Or
If Lead is on List X and List Y
      Do Not Send Email
End IF

Anyone have any thoughts on this?

Yes, that would bring in the people you want. This should be done at the smart list level, not as a Choice step.
