terms and conditions checkbox

Hi,

I have a form with a terms and conditions disclaimer and a checkbox. I have set the checkbox to be a required field i.e. the t&c must be agreed to before the form can be submitted. The checkbox is set to NOT be initially checked and IS REQUIRED - however the form still submits irrespective of whether the checkbox has been checked - is this a bug?

Any thoughts / ideas are appreciated.
