forms 2.0 - required field below progressive profiling fields

Is it possible to list a required field BELOW the progressive profiling fields on a forms 2.0?  I would like to create an "I agree with terms and conditions" checkbox but want it to always show below my progressive profiling fields.  Is this possible?

When you select Progressive profile in Forms 2.0, it creates a field set area for you to drag n' drop all the fields you want to show when returning to the form. Anything out side of that field set will Always show. Can't add a field below the progressive field set without JQuery magic.

Wish it were possible – adding a field below progressive profiling would be great.
