Have you searched the Community?  There was a recent thread that holds the answer: How to capture opt-ins

In sum, use a Rich Text widget on the form that includes the disclaimer + checkbox, then follow my directions.

Only thing is we need the disclaimer button submit button (as it's quite long) is there a way to add it?

I don't know what you mean by "the disclaimer button submit button."  Do you mean you want the disclaimer on a button?

Sorry I meant we need the disclaimer after the submit button.

OK.  This can be done (file under "place Rich Text under Submit button").  Why don't you put the form together with the rich text + checkbox, so it's otherwise working, then post the URL and I'll show you how to move the RT underneath?
