As a global company, we are using Sales Insight in Salesforce.com and Marketo to track leads, contacts and their behavior and engagement with our assets including
website, blogs, emails, downloads, webinars and other marketing campaigns.
Are there any restrictions for our Sales team using Sales Insight to view and watch prospects (leads and contacts) behaviour?

I do not think there is any legal reason that you cannot use MSI in Germany. It does not apply to the strict email regulations as it is more about web behavior. The emails sent out are also sales emails not marketing. You might want to check with your legal department about website tracking
I'd double-check the settings in Admin > Sales Insight to make sure the Unsubscribe footer is included in the sales emails, and to check with your legal team about opt-in requirements, to make sure that the leads you could be sending to have the right Unsubscribed values.
We use Marketo in Europe a lot, two things to consider:
1. Might be a good idea to sign the Safe Harbor Addendum - Update from Marketo on the EU-US Safe Harbor Framework
2. Make sure your website is in compliance with the EU Cookies and Privacy policies Handling Cookies and Privacy in the EU , because technically you are obtaining a lot of your behavioral data through Munchkin code on your website
and of course double check with your legal department
