I would consult with your firm's attorney or data privacy officer for the details. My understanding is that in Germany, you need to have this process:
- explicit opt in on the form, not pre-checked
- double opt in - confirming email with link to verify intent. (marketo can do this with Clicks Link in Email)
- Anonymous leads who visit your site will be cookied. In the EU, you must have an opt out pop up on your site, and there are several threads on this topic.
